Terms and Conditions for Sylvi
1. Introduction
Welcome to Sylvi! These Terms and Conditions ("Terms") govern your use of our mobile application, Sylvi (the "App"), which offers language learning services through AI chatbots, AI tutor, flashcards, social chat, and news. By accessing or using the App, you agree to be bound by these Terms.
2. User Registration
To use the App, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
3. Subscription Plans
Free Trial: New users will be prompted to start a free trial upon entering the App. The free trial provides access to all features of the App. You may cancel the free trial at any time before the trial is up. If you do not cancel within this period, you will be automatically billed for a Sylvi subscription.
Subscriptions are charged on a monthly, 3-monthly or annual basis. Payment will be processed through Apple's In-App Purchase system for iOS apps or Google Play Billing for Android apps. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the end of the current period.
4. Automatic Renewal and Cancellation Policies
Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle. You will be charged based on the plan you selected.
Cancellation: You may cancel your subscription at any time through your App Store account. Cancellations will take effect at the end of the current billing cycle, and you will not receive a refund for any unused portion of the subscription period. Please read our FAQ for detailed instructions on how to cancel your subscription.
5. User Conduct
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of others. Prohibited activities include, but are not limited to, harassment, spamming, and the dissemination of inappropriate or offensive content.
6. Intellectual Property
All content and materials available on the App, including text, graphics, logos, and software, are the property of Sylvi or its licensors. You may not reproduce, distribute, or create derivative works from any content on the App without our express written permission.
7. Data Privacy
We collect and use your personal data in accordance with our Privacy Policy. By using the App, you consent to our data practices, including the collection, use, and sharing of your data. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.
8. Fees and Payments
Subscription fees are outlined on the App and are subject to change. All fees are non-refundable except as required by law. If you dispute any charges, please contact us within 30 days of the charge.
9. Limitation of Liability
To the fullest extent permitted by law, Sylvi is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
10. Dispute Resolution
Any disputes arising under these Terms shall be governed by the laws of England. You agree to resolve any disputes through binding arbitration in England, rather than in court.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on the App. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

Keep it Clean: Use appropriate language. No profanity, explicit content, or offensive remarks.
No Harassment: Bullying, discrimination, or any form of harassment is strictly prohibited.
Practice Safety: Never agree to meet other users in person or move conversations to other platforms.

Remember: Violation of these guidelines may result in temporary or permanent suspension from the chat feature.
13. Apple-Specific Terms
The following terms apply to your use of the App when downloaded from the Apple App Store. These terms are in addition to the rest of these Terms and apply only to the iOS version of the App.
13.1 Acknowledgement. You and Sylvi acknowledge that these Terms are concluded between you and Sylvi only, and not with Apple Inc. ("Apple"). Sylvi, not Apple, is solely responsible for the App and its content.
13.2 Scope of License. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
13.3 Maintenance and Support. Sylvi is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
13.4 Warranty. Sylvi is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Sylvi's sole responsibility.
13.5 Product Claims. You and Sylvi acknowledge that Sylvi, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
13.6 Intellectual Property Rights. You and Sylvi acknowledge that, in the event of any third party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Sylvi, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.
13.7 Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13.9 Third Party Terms of Agreement. You must comply with applicable third party terms of agreement when using the App.
13.10 Third Party Beneficiary. You and Sylvi acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
